Afe Babalola & Olanipekun to pay #30m for APC’s ‘ frivolously’ asking for review in Bayelsa

The supreme court judge Justice Augie has awarded N10milion cost for each of the 1st, 2nd and 3rd respondents (the PDP, its governorship and deputy governorship in the last election) – Sen. Duoye Diri and. Lawrence Ewhrudjakpo – to be paid personally by the applicant’s lawyers.

Afe Babalola (SAN) represented the 1st and 2nd applicants (Biobarakuma Degi-Eremienyo), while Wole Olanipekun (SAN) represented the APC.

He handed over the fine/ punishment shortly after dismissing David Lyon’s petition in the Bayelsa guber election case before it.
Giving the lead judgment, Justice Amina Augie said the court cannot sit on appeal over its own judgment and therefore asked the counsel to pay 30 million naira for bringing a frivolous suit before the court.

The Supreme Court on Wednesday affirmed the election of Senator Douye Diri as duly elected governor of Bayelsa State.

The court also upheld its February 13 judgement that sacked David Lyon of the All Progressives Congress (APC) as Bayelsa State Governor-elect.

A seven-member panel of the court, led by Justice Sylvester Ngwuta, dismissed th two application filed and argued for the applicants by Afe Babalola (SAN) and Wole Onanipekun (SAN), and held that the applications were without merit and amounted to abuse of court process.

Justice Amina Augie, who read the lead ruling, said the application was an attempt to make the court violate its rules and the. provision of the Constitution which makes it the final court of the land.

Justice Augie said the applications, if granted has the capacity of belittling the dignity and status of the court and open a floodgate for such request in the future.

She expressed regret that senior lawyers in the country could be involved in the filing of such applications.

It will be recalled that there was tight security in and around the Three Arms Zone in Abuja as the Supreme Court on Tuesday hears an application by the All Progressives Congress (APC) to review its Feb. 13, judgment disqualifying the party’s candidate in the last governorship election in Bayelsa, David Pereworimin Lyon.

Chief Afe Babalola, SAN, led the team of lawyers for Lyon and deputy.

Also in court is the Governor of Bayelsa State, Senator Duoye Diri, National Chairman of the APC, Comrade Adams Oshiomhole.
